Damage Waiver

Northside Tool Rental’s Damage Waiver Program (“the Program”) limits Customer’s financial responsibility for certain unexpected loss of, or damage to, rental Equipment while in Customer’s possession.


THE PROGRAM IS NOT INSURANCE. It is a contractual modification of Customer’s liability under the Rental Agreement, not a policy of insurance, and it does not cover bodily injury, third-party property damage, or any liability other than Customer’s financial responsibility for loss of or damage to the rented Equipment itself.


Program Fee: 14% of rental charges, added to every rental unless Customer opts out as described below.


Opting Out: Commercial customers may decline the Program by providing NTR, before the rental begins, with a Certificate of Insurance on file with NTR showing:


  • Equipment Floater, Leased or Rented Equipment coverage (or equivalent verbiage, sometimes found under Inland Marine or Property coverage)
  • Policy number
  • Effective and expiration dates
  • A limit of coverage of $50,000 or greater
  • Northside Tool Rental listed as both Additional Insured and Loss Payee

This option is available to commercial customers only; the Program applies to all other rentals unless and until a qualifying Certificate of Insurance is on file.


Eligibility: The Program applies only if the Program fee has been paid for the applicable rental, Customer’s account is current at the time of the loss or damage, and Customer has complied with the terms of the Rental Agreement.


Equipment Damages


Equipment is considered damaged if it is returned in a materially different condition than when rented, beyond normal wear and tear. Coverage is per item of Equipment, per occurrence.


  • Qualifying damage under $250: covered 100% by the Program. Example – a $185 qualifying damage charge is fully covered; Customer owes $0.
  • Qualifying damage of $250 or more: Customer is exempt from the first $250 and is responsible for 50% of the remaining balance. Example – a $2,250 qualifying damage charge: $2,250 − $250 = $2,000 remaining balance; Customer owes 50% of that, or $1,000.

What Is Not Covered


The Program does not apply, and Customer is responsible for 100% of the resulting cost, for damage resulting from:


  • Overloading the Equipment
  • Misuse or improper use of the Equipment
  • Negligence or improper servicing of the machine
  • Damage to hoses, tires, and tracks
  • Machine roll-over
  • Improper transport of the Equipment
  • Paint or chemical overspray
  • Damage caused by any person other than Customer’s employees or authorized agents
  • Violation of any manufacturer safety instructions
  • Unauthorized alterations to the Equipment
  • Any violation of the Northside Tool Rental Rental Agreement

Field Service Calls


Service calls due to damage are not covered by the Program regardless of enrollment, and are billed at $175 per trip plus $75/hour labor.


Loss or Damage from Theft or Vandalism


  • Equipment stored in a secured location*: Customer is responsible for 50% of current replacement cost.
  • Equipment stored in a non-secure location: Customer is responsible for 90% of current replacement cost.

*Secured location means the Equipment was within a secured and locked, gated environment, or inside a secured building.


“Current replacement cost” means the cost to purchase a new unit of the same or a comparable model to replace the Equipment that was lost or stolen.


Customer’s Duty to Report Theft


  • Report the theft to NTR within 24 hours of discovery.
  • Report the theft to the appropriate police jurisdiction, and deliver a copy of the police report to NTR within 10 days.
  • Pay all theft/vandalism settlements within 10 days of the event.

Failure to meet these requirements forfeits Program coverage for that loss.


This Program is part of, and governed by, the Rental Agreement and the laws of the State of Georgia.
